This Privacy Notice explains how WakaEat collects, uses, shares, protects and retains personal information across its websites, mobile applications and related services worldwide.
1. Who this Privacy Notice applies to
- Customers who browse, order, pay for or receive food or other permitted items.
- Vendors, restaurants, chefs and business users who list products, manage orders or receive payouts.
- Riders/Delivery Partners who apply for, are verified for, or perform delivery services.
- Visitors to the WakaEat website and users of support, marketing, referral and other Platform features.
- Business partners and representatives who interact with WakaEat.
Our privacy practices vary by role, market, product and applicable law. Where a local privacy notice or addendum applies, it supplements or controls the information and rights that must be provided in that jurisdiction.
2. Who is responsible for your information
The WakaEat entity identified in your account, order, agreement, invoice, checkout, onboarding flow or applicable local privacy notice is responsible for your information as the applicable controller, business, joint controller or processor, depending on the service and jurisdiction. WakaEat LLC and its affiliates and local operating entities may process information to operate the Platform worldwide.
3. Information We Collect
Customer information
Name, email address, phone number, account credentials, delivery addresses, saved locations, order history, preferences, ratings and reviews, support communications, device information, location information where a feature requires it, transaction information and marketing preferences.
Vendor information
Legal/business name, owner and contact information, business address, tax or business identifiers, licenses and permits, payout information, menus, prices, operating hours, food and allergen information, administrator information, support communications and verification results.
Rider information
Name, contact information, date of birth or age where required, government ID details, liveness or face-match signals where used, verification outcomes, driver license, vehicle, registration and insurance information where applicable, precise location and route data, device information, payout information, delivery history, ratings, support communications and safety or incident information.
Technical and usage information
IP address, device identifiers, browser or app information, operating system, crash and performance data, cookies and similar technologies, log data, feature interactions and network information.
Communications and content
Information in messages, support tickets, attachments, surveys, ratings, reviews, photos, audio or video recordings where you submit or participate in them and where collection is permitted.
4. How We Use Information
- Create and manage accounts and provide requested services.
- Match Customers, Vendors and Riders and coordinate orders and deliveries.
- Process payments, payouts, refunds, chargebacks, accounting and tax records.
- Verify identity, business credentials, account integrity and eligibility.
- Detect, prevent and investigate fraud, abuse, safety incidents and security threats.
- Provide customer, Vendor and Rider support.
- Provide navigation, order tracking, delivery routing and location-dependent features.
- Operate, troubleshoot, analyze and improve the Platform.
- Send service, transactional, security and administrative communications.
- Send marketing and promotional communications where permitted and subject to applicable choices.
- Comply with law, respond to lawful requests, enforce agreements and protect WakaEat, users and the public.
- Support internal reporting, analytics, planning and business operations consistent with applicable law.
5. Legal Bases and Jurisdictional Rules
Depending on where you are located and what service you use, WakaEat may process personal information because processing is necessary to perform a contract; to comply with a legal obligation; for legitimate interests that are not overridden by your rights; with your consent where consent is required; to protect vital interests; or under another lawful basis recognized by applicable law.
Where consent is required, WakaEat will seek it and provide a practical way to withdraw it. Local privacy addenda may explain additional legal bases or conditions.
6. Identity and Business Verification
WakaEat may use third-party identity and business verification providers, including Didit or comparable providers. Depending on the workflow, a verification provider may process government-issued identification documents, liveness or face-matching signals, business records, sanctions or fraud-screening signals and verification metadata.
- WakaEat may receive a verification result, reference ID, risk signal or other limited output instead of retaining every raw document.
- Where biometric or other sensitive identity information is processed, WakaEat seeks to limit processing to what is legally permitted and reasonably necessary for the verification purpose.
- Background or eligibility checks may be performed when required by law, needed for safety or compliance, required by an insurance or payment arrangement, or included in a market-specific onboarding policy. WakaEat does not use a universal SSN requirement as part of its global privacy model.
7. Location and Delivery Data
- Customers: location may be used for service availability, restaurant discovery, address validation and delivery.
- Riders: precise location may be used while online or completing a delivery for dispatch, navigation, safety, delivery status, support and operational analytics.
- Vendors: location may be used to configure service areas, restaurant discovery and order logistics.
- WakaEat may use location and route information for fraud prevention, safety, analytics and service improvement consistent with applicable law.
You can control certain device-level location permissions. Disabling required location access may make some Platform features unavailable.
8. Payments and Financial Information
WakaEat may use payment providers such as Stripe, Flutterwave and other market-specific providers. WakaEat generally does not need to store full payment-card credentials when those credentials are processed directly by a payment provider.
- We may retain transaction records, payment status, masked identifiers, payout records, refunds and related financial information for accounting, fraud prevention, customer support and legal compliance.
- Vendor and Rider payout information may include bank or wallet details and tax information required by the applicable payment or legal framework.
9. How We Share Information
- With Vendors, when necessary to prepare and fulfill a Customer order.
- With Riders, when necessary to pick up and deliver an order.
- With Customers, where needed to show Vendor information and delivery progress.
- With service providers that support hosting, payments, identity verification, messaging, maps, analytics, customer support, fraud prevention, security and related infrastructure.
- With WakaEat affiliates and local entities when necessary to operate the Platform and support users.
- With law enforcement, regulators, courts, insurers, auditors or other parties when required or permitted by law.
- With transaction counterparties in connection with a merger, acquisition, financing, reorganization or sale of assets, subject to applicable law and appropriate protections.
10. Information Shared with Vendors and Riders
WakaEat limits the personal information provided to another marketplace participant to what is reasonably necessary for the relevant transaction or operational purpose. Vendors and Riders must use Customer information only for permitted purposes, protect it appropriately and comply with applicable law and their agreements with WakaEat.
Vendors and Riders may not use Customer information for independent marketing, resale, harassment, tracking outside the transaction or unrelated profiling. WakaEat may limit or withdraw Platform data access after suspension or termination.
11. Cookies, SDKs and Similar Technologies
WakaEat may use cookies, mobile SDKs, pixels, logs and similar technologies to maintain sessions, remember preferences, secure accounts, measure performance, understand usage, support advertising and improve the Platform. Where applicable law requires consent for non-essential technologies, WakaEat will provide the applicable consent or settings mechanism.
12. Marketing and Communications
Transactional messages may be necessary to operate the service. Marketing communications are subject to applicable consent and opt-out requirements. You may opt out of marketing email, SMS or push notifications using the available unsubscribe or account controls, subject to reasonable operational exceptions.
13. Data Retention
WakaEat retains personal information only for as long as reasonably necessary for the purposes described in this Notice, including service delivery, security, fraud prevention, legal obligations, dispute resolution, accounting, tax, insurance and enforcement. Retention periods vary by data category, role, market and law.
Where possible, WakaEat may delete, de-identify or aggregate information when identifiable information is no longer required. Verification providers may maintain their own retention periods under their agreements and policies.
14. Security
WakaEat maintains administrative, technical and organizational safeguards appropriate to the nature of the information processed. Measures may include access controls, encryption, authentication, logging, secure development practices, vendor due diligence and incident response processes. No system can be guaranteed to be completely secure.
15. International Data Transfers
Because WakaEat operates globally, personal information may be processed in countries other than the country where it was collected, including the United States and countries where WakaEat or its service providers operate. Where the applicable law requires a transfer mechanism or additional safeguard, WakaEat will use a lawful mechanism, which may include adequacy decisions, contractual safeguards, consent where valid, or another recognized transfer basis.
16. Your Privacy Rights
Depending on your location, you may have rights to access, correct, delete, restrict, object to or port certain personal information; withdraw consent where processing relies on consent; obtain information about processing; opt out of certain targeted advertising or data sharing activities; or lodge a complaint with a supervisory authority.
Rights and procedures vary by jurisdiction. WakaEat will provide the rights, appeals and verification process required by applicable law and any applicable regional privacy addendum.

17. Automated Decision-Making and Profiling
WakaEat may use automated systems for fraud detection, identity verification, account security, dispatch and matching, personalization, pricing, promotions or service quality. The scope and legal basis may vary by market.
Where applicable law provides rights relating to solely automated decisions with legal or similarly significant effects, WakaEat will provide the notices, explanations, human review or appeal mechanisms required by that law.
18. Children
WakaEat is designed for adults and does not knowingly seek to create accounts for persons under 18 unless a specific service is lawfully designed for minors and its applicable terms expressly allow it. If WakaEat learns that it collected personal information from an underage person contrary to applicable law, it will take appropriate steps to delete or restrict the information.
19. Business Transfers
If WakaEat is involved in a merger, acquisition, financing, restructuring, bankruptcy or sale of assets, personal information may be transferred as part of the transaction subject to applicable law and appropriate confidentiality and security protections.
20. Regional Privacy Addenda
Because privacy laws differ by jurisdiction, WakaEat may publish supplemental privacy terms for specific countries, states, provinces, cities, products or roles. These addenda may identify the applicable WakaEat entity, legal bases, additional data categories, local rights, appeals procedures, sensitive-data rules, cookies, representative contacts, data-protection officers, complaint channels and other required disclosures.
Regional supplements may apply in the United States, European Economic Area, United Kingdom, Switzerland, Nigeria, Brazil, Canada and other jurisdictions where additional disclosures or rights are required.
21. Changes to This Privacy Notice
WakaEat may update this Privacy Notice as the Platform, law and privacy practices evolve. Where applicable law requires additional notice or consent, WakaEat will provide the required process before a material change takes effect. The “Last Updated” date will appear at the top of the published Notice.
